DEFINITIONS

“Confidential Information” means any written or oral information that is provided by or disclosed directly or indirectly through any means that is not already in public and may include business structures, methods, procedures and personal information.

“Content” means any and all material, links, words, images, photographs, uploads, notes, recordings, or videos that may be placed on this site, including but not limited to any goods and services on the website.

“Member” means a member of the Victorian Facetors’ Group Inc.

“Posts” means any recommendations, comments, information, images, videos, photographs, messages, notes, texts, recordings or any other material that you place or upload on this website.

“Services” means the Victorian Facetors’ Group Inc.’s various activities offered through the membership, including but not limited to workshops, competitions, and other activities.

“The website” means Victorianfacetorsgroup.com.

“We”, “Our”, and “Us” means the Victorian Facetors’ Group Inc., victorianfacetorsgroup.com and includes all officers, directors, employees, contractors and affiliates.

“You” “User” means a Member or other person using our Services and, by doing so, agrees to these Terms.

MEMBERSHIP APPLICATION

You need first to fill out our application form and pay the membership fee in advance in order to sign up for our Services and to receive any newsletters, information and associated services.

MEMBERSHIP PAYMENTS

Your membership commences when you complete the registration process. Your membership fee and future annual fees will continue to be deducted by the payment method notified to us indefinitely until cancelled by you. We will send you an annual invoice and a renewal form in the event you wish to update your personal details.

You may cancel your membership by notifying us prior to the renewal of the next membership year. We do not provide full or any pro-rata refunds for any part-year cancellation.

We reserve the right to provide additional or add-on services at further costs. The acceptance of such services will be at your discretion and subject to any further terms or conditions that may be made available to you at the time such services are offered.

Prices may vary from time to time. You will be notified of any price increase, and unless you cancel your membership, agree to such an increased fee being deducted from your preferred payment method.

These terms of payment have been made available to you prior to your registration and acceptance of the terms on the payment page of the website.

AGREEMENT FOR MEMBERSHIP SERVICES

When you join our website or the Victorian Facetors’ Group Inc. and use our Services, you acknowledge and agree to the following:

●    You warrant that you are at least 16 years of age or otherwise will provide us with your parental or guardian consent, and you will keep your contact and other information updated at all times;

●    You warrant that all information you provide is true, correct, up-to-date and accurate personal information and details;

●    We, at all times, abide by the Australian Privacy legislation. Please refer to our full Privacy Policy on our website for details of how we collect, store and use your personal information;

●    You will not transfer, sublicense or grant access for any of our Services to any other person, business or another third party except as agreed in these Terms;

●    You agree to receive from the website email information from time to time concerning contests, reminders, updates or other services offered by us;

●    That unless you notify us otherwise, we share the membership contact list with your name, phone, state and email with other members. Please let us know if you do not want your details made public to other members at any time;

●    Any interaction, correspondence, meetings you have or information you pass on to other members is done at your own discretion and at your own risk. We are not responsible for any actions of any other member at any time; and

●    We are at no time responsible for any loss or damage to any tools or other personal belongings.

DISCLAIMER

We are at no time responsible for any loss, damage, or injury you may suffer as a direct or indirect result of using our Services, including but not limited to any workshop you may attend or other activity you may be part of at any venue.

You take full responsibility and risk for using our Services and attending any session, workshop, venue or activity. You hereby agree to irrevocably release and waive any claims you may have now or in the future against us. We take no responsibility or liability whatsoever for any loss, damage or injury that may arise from any information, goods or services you may choose to use or any workshop you may attend as part of your membership or accessed through or using this website. All such liabilities are expressly disclaimed.

We make no representation or warranties as to the accuracy, content or any warranties for any third parties or other member’s products or services that you may access on or through our website.

REFUND AND TERMINATION

REFUND: We, at all times, abide by the Australian Consumer Law in relation to any guarantees for our Services. We do not, however, offer refunds for change of mind or part membership term.

WE MAY TERMINATE YOUR MEMBERSHIP AT ANY TIME: We may, in our sole discretion, terminate or suspend your access to the website with or without notice and for any reason, including, without limitation, breach of these Terms. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your membership and may be referred to the appropriate law enforcement authorities.

Upon such termination, regardless of the reasons, your right to use the website immediately ceases, and you acknowledge and agree we may immediately deactivate or delete your account and all related information and files. We may also bar you from any further access to our website and Services. We shall not be liable to you or any third party for any claims or damages arising out of any termination or suspension or any other actions taken by us in connection with such termination or suspension.

Should you cancel your membership or our Services for any reason, the cancellation will only take effect from the end of the billing period in which you cancel your membership service.

We are not required to provide any refund or part thereof to you for such termination of your membership.

OWNERSHIP OF INTELLECTUAL PROPERTY

Materials, educational content and other information (together “Materials”) may be provided to members from time to time during and to enable the provision of the Services. All Materials are provided without warranties of any kind, both express and implied. Any Materials, designs, analyses, processes, discussions and other intellectual property, both tangible and intangible, which is provided or may be developed as a result of or during the Services is and will remain the property of the Victorian Facetors’ Group Inc. at all times and may not be resold, shared, used commercially or otherwise used for other than individual personal use.

For the sake of clarity, no Materials may be reproduced or used for any purpose other than the personal private use of the individual Member. At no time may it be reproduced and provided to third parties without the express written permission of Victorian Facetors’ Group Inc.

LIABILITY 

You agree and acknowledge that we are not liable for any direct, indirect, consequential or incidental loss or damage resulting from your use of our website, the Services or any information contained on it or linked to it.

In using our Services, you agree you are doing so at your own risk, and we cannot be held responsible for the action you may decide to take based on your decisions or actions that may result from our Services.

For the sake of clarity, in no event will we be liable for any consequential, indirect, incidental or special damages of any kind, including any damages for loss, injury or death.

Certain legislation, including the Australian Consumer Law (ACL) in the Consumer and Competition Act 2010 (Cth), and similar consumer protection laws and regulations may confer you with rights, warranties, guarantees and remedies relating to the provision of Services by us to you which cannot be excluded, restricted or modified (Statutory Rights).

Our liability is governed solely by the ACL and these Terms. We exclude all conditions and warranties implied by custom, law or statute except for your Statutory Rights.

Services: To the extent we are unable to exclude liability; our total liability for loss or damage you suffer or incur from our Services is limited to us re-supplying the Services to you or, at our option, us refunding to you the amount you have paid us for the Services to which your claim relates.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

BLOG COMMENTS, RULES AND RETENTION OF CONTENT

We reserve the right at any time and from time to time to modify the Website with or without notice. We shall not be liable to you or any third party for any modification, price change, suspension or discontinuance of the Website.

By using our website and/or contributing to or participating in any comments or blogs, you agree to the following terms:

●    Any recommendations, comments, information, images, videos or posts (together “Posts”) you make to our website and any Blog post will abide by our terms and will be made in the spirit, culture and ethos of the website.

●    You will not harass or stalk any user, impersonate any other person or collect information about other users.

●    You agree you will only make correct, accurate Posts in good faith and will not use aggressive, defamatory, rude, or offensive language. We will not condone any bad language, nor will we permit false claims, defamation, harassment, fraud, collusion, or Posts that may offend any person, visitor, or other third parties. We can at any time, in our sole discretion, remove any Post and block your access to our website without notice.

●    Posts are not permitted that:

o    encourage illegal intent

o    exploit minors

o    show or contain cruelty to animals

o    show or contain extreme violence

o    show or contain illegal activities

o    contain ads, links or other forms of advertising

o    solicit or promote business

o    are abusive or malicious against any other participant, Member, our staff or any third party; or

o    are false and misleading

GOVERNING LAW

These Membership Terms are governed by the laws of Victoria, which are in force from time to time, and both you and we agree to submit to the exclusive jurisdiction of the Courts of Victoria for determining any dispute concerning these Terms.
